We will respect your privacy, be transparent about our data practices, keep your data safe, never sell your personal data and only collect data that helps us improve our products and services.
Individuals Under the Age of 18
The Lume Services are not intended for individuals under 18 years of age. No one under age 18 may provide any information to or on the Lume Services. We do not knowingly collect personal information from anyone under 18. If you are under 18, do not use or provide any information on this Lume Services or on or through any of its features/register on the Lume Services, make any purchases through the Lume Services, use any of the interactive features of this Lume Services or provide any information about yourself to us, including your name, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received personal information from someone under 18 without verification of parental consent, we will delete that information. If you believe we might have any information from or about an individual under 18, please contact us at email@example.com.
When We Collect Data
When activating a Lume Device, you will be asked to download the Lume App or install Software and enter information about yourself, such as age, height, weight and gender. We use this information to personalize your Lume experience – for example, body mass index, body composition, calories burned and consumed, calorie deficit and recommendations for achieving your health and weight goal. The Devices you use can collect data such as the number of calories you consume, the number of calories you burn and the number of calories you need to maintain your weight goal, your weight, and transmit this data to MetaLogics.
When You Create a Lume Account
If you want to access data collected by your Devices, you must create a Lume account. When you create a Lume account, we ask for some personal information, including your mobile device number, your email address, your date of birth and your height. Your mobile device number will be your Lume account user name, which you will use to log-into your account. We do not display your email address or mobile phone number to other users.
When You Visit Our Sites
Lume collects industry standard data from everyone who visits our Sites—even if you don’t have a Lume account. This includes log data that automatically records information about your visit, such as your browser type, operating system, the URL of the page that referred you, the different actions you performed, and the IP address you used to access pages on the Site. We use this type of information to provide you with an experience that’s relevant to your location based on the IP address, to prevent Site misuse, and to ensure the Site is working properly. We may also collect data from cookies.
When You Sync Your Device
When you sync your Devices through an App or the Software, data recorded on your Device about your activity is transferred from your Device to your mobile device and to our servers. This data is stored and used to provide the Lume Service and is associated with your account. Each time a sync occurs, we log data about the transmission. Some examples of the log data are the sync time and date, device battery level, and the IP address used when syncing.
When You Contact Us
Whenever you contact Lume for help, we collect your name and email address along with additional information you provide in your request so that we can provide you with assistance and improve the Lume Service.
Why We Collect Data
Lume uses your data to provide you with the best experience possible, to help you make the most of your health, and to improve and protect the Lume Service.
Here are some examples:
- Height, weight, gender and age are used to determine the number of calories you consume and burn, your body mass index and your body composition.
- Contact information is used to send you notifications, and to inform you about new features or changes to the Lume Products or Lume Service.
- Data and logs are used in research to understand and improve the Lume Products and Lume Service; to troubleshoot the Lume Service; to detect and protect against error, fraud or other criminal activity; and to enforce the Lume Terms of Service.
- De-identified data that does not identify you may be used to inform the health community about trends; for marketing and promotional use; or for sale to interested audiences.
What Kinds of Data We Share
DATA THAT COULD IDENTIFY YOU
Personally Identifiable Information (PII) is data that includes a personal identifier like your name, email or address, or data that could reasonably be linked back to you. We will only share this data under the following circumstances:
- With companies that are engaged in providing us with services, such as the organization that invited you to participate in the Lume Beta Trial or companies that contract with us to support the Lume Service. These companies are obligated by contract to safeguard any PII they receive from us.
- If we believe that disclosure is reasonably necessary to comply with a law, regulation, valid legal process (e.g., subpoenas or warrants served on us), or governmental or regulatory request, to enforce or apply the Terms of Service, to protect the security or integrity of the Lume Service, and/or to protect the rights, property, or safety of Lume, its employees, users, or others. If we are going to release your data, we will do our best to provide you with notice in advance by email, unless we are prohibited by law from doing so.
DATA THAT DOES NOT IDENTIFY YOU (DE-IDENTIFIED DATA)
MetaLogics may share or sell aggregated, de-identified data that does not identify you, with partners and the public in a variety of ways, such as by providing research or reports about health and weight loss. When we provide this information, we perform appropriate procedures so that the data does not identify you and we prohibit recipients of the data from re-identifying it back to you.
DATA THAT YOU DIRECT US TO SHARE
MetaLogics may also ask you to participate in surveys (processed by Lume or third parties) that help us understand your use of the Lume Service. Any PII you provide to MetaLogics (or supplied by you or to such third-party survey providers) in connection with these surveys will only be used in relation to that survey and as stated in this policy.
OTHER REASONS WE MAY SHARE DATA
We may also disclose your personal information:
- To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
- If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of MetaLogics Corporation, our customers, or others.
Data Storage and Security
How Long We Save Your Data
We store your PII for as long as you maintain a Lume account or for a reasonable period of time thereafter.
How To Deactivate Your Lume Account
You can deactivate your Lume account by contacting MetaLogics. When you do, data that can identify you may not be immediately removed from the Lume Service, including but not limited to your email, and name. Backup copies of this data will be removed from our server within a reasonable period of time, which means it may persist in our archive for a short period. Lume may continue to use your de-identified data after you deactivate your account.
How Does Lume Keep My Data Safe?
We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on U.S. Heath Information Portability and Accountability Act (HIPAA) compliant servers contracted through Amazon Web Services. The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our App, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.
Unfortunately, the transmission of information via the internet and mobile platforms is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted through the Lume Services. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures we provide.
Automatic Data Collection Procedures
As you navigate through and interact with the Sites, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:
- Details of your visits to our Sites, including logs and other communication data and the resources that you access and use on the Website.
- Information about your computer and internet connection, including your IP address, operating system, and browser type.
The information we collect automatically is statistical data and does not include personal information.
The technologies we use for this automatic data collection may include:
Web Beacons. Pages of our Sites [and our e-mails] may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us, for example, to count users who have visited those pages or [opened an email] and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity).
When you download, access, and use the App, it may use technology to automatically collect:
Usage Details. When you access and use the App, we may automatically collect certain details of your access to and use of the App, including logs, and other communication data and the resources that you access and use on or through the App.
Device Information. We may collect information about your mobile device and internet connection, including the device’s unique device identifier, [IP address,] operating system, browser type, mobile network information, and the device’s telephone number.
If you do not want us to collect this information do not download the App or delete it from your device.
DOES metalogics HONOR “DO NOT TRACK” SIGNALS?
Although we would like to honor the browsers set with a “Do Not Track” signal, the Sites do not currently respond to a DNT or similar signal as it awaits the results of efforts by the policy and legal community to determine the meaning of DNT and the proper way to respond.
